The Supreme Court's “Kelo” decision has re-written the Constitution and
given governments at all levels the power to seize your personal property
for the benefit of private interests. Legislation pending in Congress (S.
1313) seeks to limit this new governmental power. But S. 1313 has severe
weaknesses — it lacks a statement of Constitutional authority and an

Emminent Domain is needed only in dire circumstance... an example would be a
strand of 5 houses sits in the way of a 50 mile stretch of highway that is
needed...

Not for football stadiums...

Agreed, but that's not what our elected representatives and judicial
system have decided.

Not anymore, sigh. The Supreme Court ruled it is OK to seize private
property for other than public projects. Florida and many other states
I understand are creating legislation to stop this travesty.

Eminent domain is never needed and is never justified. What is the definition
of "just compensation"? If you have a piece of property and will not sell it
for (say) the average selling price of similar nearby property, what does that
say? It says you (personally) place a higher value on that property than
someone else might. Should you be forced to sell at a price someone else
considers "reasonable"? Why is it that someone else has more rights to your
property than you yourself do?

The only way to determine what "just compensation" is is to continually raise
the offer until the price is accepted. If a city/county/state puts itself in
the position of having to offer millions for a postage stamp that's just too
bad.
